Please read these Terms of Service carefully before using the 2find platform operated by Golden Stack (Pty) Ltd.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Definitions

  • Company refers to Golden Stack (Pty) Ltd, 280 Olivier Street, Brooklyn, Pretoria, Gauteng.
  • Service refers to the 2find website and mobile application.
  • User means any individual who accesses or uses the Service.
  • Business Account means an account registered for the purpose of listing a business or event on the platform.
  • Listing means a business or event profile submitted by a Business Account user.

2. Use of the Service

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates any applicable local, national, or international law or regulation.
  • To transmit any unsolicited or unauthorised advertising or promotional material.
  • To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service.
  • To submit false, misleading, or inaccurate information in any Listing.

3. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.

4. Listings

By submitting a Listing, you confirm that:

  • The information provided is accurate, truthful, and not misleading.
  • You have the right to list the business or event and represent it on the platform.
  • The Listing does not infringe any third-party intellectual property rights.
  • The business or event complies with all applicable laws and regulations in South Africa.

The Company reserves the right to approve, reject, or remove any Listing at its sole discretion, including Listings that violate these Terms or are deemed inappropriate or harmful.

5. Subscriptions and Payments

Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as set out on the platform.

  • Billing: Subscriptions are billed on a monthly or annual basis as selected at the time of purchase.
  • Cancellation: You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period.
  • Refunds: Subscription fees are non-refundable except as required by applicable law.
  • Price changes: The Company reserves the right to modify subscription pricing with reasonable prior notice.

Payments are processed through PayFast. By making a payment, you also agree to PayFast's terms and conditions.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Golden Stack (Pty) Ltd and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

By submitting content (including images, descriptions, and other materials) to the platform, you grant the Company a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content solely for the purpose of providing and promoting the Service.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

The Company does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

The Company does not endorse, verify, or guarantee the accuracy of any information provided in Listings. Users are encouraged to independently verify any business or event information before making decisions based on it.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of these Terms. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
